Terms of Service
Last updated: 1 January 2025. These Terms of Service govern your use of the website at craftbuiltcarpentry.online and the engagement of services provided by Craft Built Carpentry Pty Ltd (ABN 88 703 375 811).
1. Agreement to these Terms
By accessing this website, submitting an enquiry, requesting a quote, or engaging Craft Built Carpentry Pty Ltd (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please discontinue use of the website and do not engage our services.
2. Who We Are
Craft Built Carpentry Pty Ltd is an Australian proprietary limited company registered in Victoria, trading from Melbourne VIC under ABN 88 703 375 811. We provide professional carpentry and building-related services, including bespoke joinery, structural framing, decking and pergolas, renovations, and commercial fit-outs for residential and business clients across metropolitan Melbourne.
3. Quotes, Estimates and Scope of Work
- All quotes issued by us are valid for thirty (30) days from the date of issue unless otherwise stated in writing.
- Quotes are based on the scope of work, site conditions and information made available to us at the time of assessment. Where site conditions differ materially from what was disclosed, we may issue a revised quote or variation before proceeding.
- Estimates provided without a formal site inspection are indicative only and do not constitute a binding offer.
- Any variation to an agreed scope of work must be requested and approved in writing (including by email) before the varied work is carried out. Additional costs arising from approved variations will be itemised separately.
4. Engagements and Performance
Acceptance of a quote, payment of a deposit, or written confirmation of engagement forms the agreement between you and us, together with these Terms of Service. We will perform all works with due care and skill, using materials appropriate to the agreed scope and in accordance with Australian standards and applicable Victorian building regulations. Commencement and completion dates are estimates and may be affected by weather, site access, availability of materials, statutory approvals and other matters beyond our reasonable control. Where delays occur, we will notify you promptly and agree on revised timing in good faith.
5. Payment Terms
- Deposits and progress payments may be required as set out in your written quote or engagement agreement.
- Unless otherwise agreed in writing, invoices are payable within fourteen (14) days of issue.
- All prices are quoted in Australian dollars and include GST where applicable.
- Overdue amounts may attract interest and reasonable recovery costs. We may suspend works on unpaid invoices after providing written notice.
- Materials supplied by us remain our property until payment is received in full.
6. Australian Consumer Law
Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantees, rights or remedies that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot lawfully be excluded.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including a guarantee that services will be rendered with due care and skill and will be reasonably fit for purpose. Where our services fail to meet a consumer guarantee, you may be entitled to have the services re-supplied or, in some circumstances, to a refund or compensation.
For further information about your consumer rights, visit the Australian Competition and Consumer Commission website at accc.gov.au or Consumer Affairs Victoria at consumer.vic.gov.au.
7. Limitation of Liability
To the fullest extent permitted by law, and subject always to section 6, our total liability arising out of or in connection with the services is limited, at our option, to the re-supply of the services or the payment of the cost of having the services re-supplied. We are not liable for indirect, incidental or consequential loss, including loss of profits or anticipated savings, except where such liability cannot lawfully be excluded. Nothing in this section limits your rights under the Australian Consumer Law.
8. Client Responsibilities
- You agree to provide safe and reasonable access to the worksite at agreed times.
- You warrant that you own or are authorised to carry out works at the property and that required permits, approvals or body corporate consents have been obtained where they are your responsibility under the engagement.
- You agree to disclose any known hazards, asbestos, underground services or structural issues relevant to the worksite before works commence.
